These general conditions govern the completion and execution of contracts of sale and purchase concluded through the website shop.topview.co.uk (hereinafter \"The Site\").
The means through which these contracts are concluded, qualifies them as Distance Contracts, pursuant to Part III, Title III, Chapter I, Section II of Legislative Decree 6.9.2005 n. 206 (henceforth the \"Consumer Code\") in particular art. 45 ss. to whose rules, where not derogated, specified or supplemented below, it is intended to refer and other applicable laws.
Owner of the site, as well as \"seller\" under the norm referred to, is TopView S.r.l. - headquartered in Via Alessandro Pertini 25d, 81020 San Nicola La Strada (CE) - Italy, P.IVA 03920880618.
The following general terms and conditions apply to all orders placed through the Site by consumers and professionals.
A consumer is a natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. A professional is the natural person or legal entity acting in the exercise of its entrepreneurial, commercial, craft or professional activity.
For professionals, these general conditions prevail over any contradictory or conflicting general conditions that may have been prepared by the contracting professional. Such additional or contradictory conditions may be admitted as part of the contract only with our express consent. <\/p>\n

1 Mode of purchase<\/span><\/strong><\/p>\n

The Customer may purchase the products visible on the Site: illustrated on the homepage, within the respective sections by product category, as described in the relevant information sheets.
Each product is clearly identified and, where necessary, its features and functionalities are illustrated, in the relevant description sheets published on the Site or, if present, in the \"user manual\" of the product itself.
The products published on the Site may be:<\/p>\n

    \n
  • \"Available\" physically in stock and therefore, as such, orderable by the Customer;<\/li>\n
  • \"Available to order\" means not yet in stock, but can be ordered by the Customer;<\/li>\n
  • \"Out of stock\" In this case, the product cannot be ordered by the Customer. <\/li>\n<\/ul>\n

    In order to make purchases, it is necessary for the Customer to be registered on the Site.
    At the time the purchase is made, the Customer has the opportunity to choose the delivery address and payment method for the product that he\/she prefers.<\/p>\n

    Receipt of the order by shop.topview.co.uk is confirmed by sending a confirmation e-mail to the e-mail address communicated by the Customer when placing the order at the Site.
    The Customer agrees to verify the accuracy of the data in the order confirmation email and promptly report to shop@topview.it any errors and\/or omissions.
    Confirmation of receipt of the order does not imply acceptance of the order by TopView
    TopView S.r.l. reserves the right, at its sole discretion, not to accept the order: in the event it will be our care to communicate the cancellation of the order.
    The order receipt confirmation e-mail contains the following data:<\/p>\n

    • Product(s), quantity, price<\/li>\n
    • Chosen payment method<\/li>\n
    • Shipping costs<\/li>\n
    • Total order amount<\/li>\n
    • Bank references of TopView (in case payment by wire transfer was chosen)<\/li>\n
    • Billing and shipping address<\/li>\n<\/ul>\n

      If the Product ordered is available, TopView will send the customer an e-mail message, confirming the completion of the order and the conclusion of the contract. This message will also contain a copy of these TopView Terms of Sale the indication of the purchased Products, the purchase price. A copy of the concluded contract will be kept in TopView's computer files for as long as necessary in accordance with applicable laws.
      If the Product ordered is not available, TopView will promptly notify the customer and, if the price has already been paid, will refund the full amount to the customer as soon as possible and no later than 10 business days.
      If the payment is refused, the purchase order will be cancelled and TopView will promptly notify the customer. The customer will have the option to submit a new purchase order and select a new payment method. <\/p>\n

      1.1 Prices<\/strong>
      The price is indicated in the description sheets of each product.
      All prices shown on the site are exclusive of VAT. Taxes are calculated at the order summary stage based on the customer's shipping address.
      In the event that incorrect prices are identified due to technical anomalies, shop.topview.it reserves the right to cancel the order and refund any amount paid. <\/p>\n

      1.3 Payment<\/strong>
      The available payment methods are:
      - Bank transfer
      - PayPal<\/p>\n

      1.3.1 Bank Transfer<\/strong>
      With the bank transfer, the entry of the relevant data by the Customer takes place directly on the bank's website, which guarantees the maximum security and confidentiality of the transaction.
      The customer must enter the order number in the reason for the transfer to allow TopView to verify the payment.
      TopView Srl guarantees the shipment of the material no later than 10 working days from the date of receipt of the transfer of the order itself.
      <\/strong><\/p>\n

      1.3.2 Paypal<\/strong>
      Paypal is a quick payment system. Once the relevant option has been exercised, the buyer will be redirected to the PayPal site, where they can access their account by entering their personal e-mail address and password. By choosing to pay with PayPal, the amount is charged directly to the assigned credit or prepaid card. PayPal protects the buyer's information as no financial information is passed. A confirmation e-mail from PayPal will be sent with each transaction made by this method. The amount of the order is charged to the PayPal account at the time the order is acquired and TopView Srl guarantees shipment of the material no later than 10 working days from the date of closing and payment of the order. <\/p>\n

      1.4 Invoice Iss<\/strong>uance
      The issuance of the purchase invoice follows successful payment and shipment of the material itself. The fiscal document will be sent in electronic format via e-mail. <\/p>\n

      2.2 Product delivery method<\/strong><\/p>\n

      The products ordered are delivered to the recipient and to the address specified by the Customer in the order form, by means of a courier contracted by TopView Srl.
      Once the products have been delivered to the carrier, the Customer will receive an e-mail confirming the shipment.
      Deliveries are made from Monday to Friday, during normal office hours, excluding national holidays and the period between the 8th and the 23rd of August. Delivery is considered completed when the product is made available to the Customer at the address specified in the order form. <\/p>\n

      2.3 Non-receipt of the order<\/strong>
      In the event that the recipient of the products is absent at the specified address, the courier will leave at the latter a card containing the information necessary to allow the customer to make a new appointment compatible with its availability. In the event that, in the five working days following the non-receipt of the order, the user should fail to contact the courier at the telephone number provided to agree on a new delivery date, the latter will return the material to TopView Srl. In this case, the contract of sale will be considered terminated for fact attributable to the Customer and TopView Srl will refund the price paid, after deducting the charges incurred for the storage of the package at the local carrier and the subsequent return of the same, without the application of penalties or other recharges
      The termination of the contract and the amount of the refund will be communicated by e-mail.
      The total amount of the refund will be credited to the means of payment used by the Customer for the purchase.
      <\/strong><\/p>\n

      2<\/strong>.4 Defect found upon delivery<\/strong>
      The Customer is required to check the condition of the delivered product. In the event that the package shows obvious signs of tampering or alteration, the Customer must refuse the delivery or, if he accepts it, it will be on care to affix on the transport document a description of the defect found and still give prompt notice to the Customer Service of TopView Srl at assistenza@topview.it. <\/p>\n

      3 Right of withdrawal<\/strong><\/p>\n

      Pursuant to Article 64 et seq. of the Consumer Code, the Consumer Customer (i.e., a natural person who purchases goods for purposes not related to his or her professional activity, i.e., without indicating a VAT number) has the right to withdraw from the purchase contract for any reason and without explanation, under the conditions set out below. <\/p>\n

      In order to exercise this right, the customer must send, within 10 working days from the date of receipt of the goods, a communication by which he specifies unequivocally his decision to withdraw from the contract. This communication may be made, within the aforementioned period, by registered letter with acknowledgment of receipt or by telegram, telex, e-mail or fax provided that it is confirmed by registered letter with acknowledgment of receipt within the following 48 hours <\/p>\n

      Under penalty of forfeiture of the right of withdrawal, within the same terms as above, the Customer must return - meaning delivery to the same address.<\/p>\n

      The costs of returning the products covered by the contract made subject to withdrawal will remain the responsibility of the customer.
      The substantial integrity of the goods to be returned is an essential condition for the exercise of the right of withdrawal. In particular, the return of products without their original packaging will not be considered appropriate.
      In particular, if the products are not packed properly to avoid damage during transportation or if reasonable care is not taken, TopView reserves the right not to accept the return.
      Having ascertained the recurrence of the requirements for the validity of the withdrawal exercised by the Customer (timeliness of the communication and delivery of the products as well as the integrity of the products) TopView will refund the full price paid, without additional charges, by crediting the same payment instrument used for the balance of the order.
      Shipping costs remain the responsibility of the customer.<\/p>\n

      4 Service and Warranty<\/strong>
      TopView Srl will provide all necessary support and information with respect to the service request. In order to benefit from the warranty services of TopView Srl, the customer must contact the e-mail address assistenza@topview.it providing a description of the product that is assumed to be defective and indicating the nature of the defect found and the date of acquisition, attaching a copy of the relevant invoice.
      The warranty regime on the Products differs depending on whether the customer is a \"consumer\" or a \"professional\" within the meaning of the Consumer Code. <\/p>\n

      4.1 If the customer is a consumer<\/strong>
      1. If purchasing as a consumer under the Consumer Code, the customer benefits from the legal warranty of the Products (\"Legal Warranty\"). The Legal Warranty covers any defects in conformity and operation of the Products pursuant to Articles 128 ff. of the Consumer Code. <\/p>\n

      2. If the Product is subject to the Legal Warranty, the customer shall be entitled to the restoration of the conformity and functionality of the Product by repair or replacement, or, if this is not possible, to a reduction in the purchase price or termination of the contract in accordance with the provisions of art. 135 bis et seq. of the Consumer Code. TopView Srl is liable for defects in functionality if they occur within two years from the date of delivery of the goods. To benefit from the Legal Warranty, the customer may report the defect within the term of twenty-six months from its discovery. <\/p>\n

      3. The Legal Warranty shall not apply if the reported defect and\/or defect is due to the Customer's fault, negligence or willful misconduct, or to causes attributable to the Customer and in any case not attributable to TopView, including but not limited to use not in accordance with the instructions accompanying the Product, tampering, modifications and\/or variations not authorized by TopView and\/or the use of non-original parts, accessories and spare parts.<\/p>\n

      4.2 If the customer is a professional<\/strong>
      If purchasing as a professional within the meaning of the Consumer Code, the customer benefits from a 1-year warranty from delivery of the Product.
      Verified the recurrence of the formal requirements for the use of the warranty service, TopView Srl will provide, through the same e-mail address, the necessary instructions for the shipment of the product, exclusively through agreed courier and at its own expense.
      Upon receipt of the product, the staff in charge of TopView Srl, will verify the consistency between the date of purchase indicated in the invoice sent by the customer and the code characterizing the product, made this verification, the product will be subjected to technical investigations in order to verify the existence of the alleged defect and its qualification as a lack of conformity under the rules mentioned.<\/p>\n

      If the warranty is confirmed to be effective, TopView Srl will notify the customer and replace the defective product, at no additional charge to the customer.
      In the event that either verification gives a negative result, TopView Srl will charge the customer for the charges incurred for the withdrawal of the product, the return of which will be subject to the payment of these costs in cash on delivery.
      The customer forfeits the warranty in all cases in which the purchased goods are used together with non-original spare parts or accessories or in a manner not in accordance with the product specifications or the user and maintenance manual, as well as in the case of incorrect installation of accessories.
      The warranty is void if parts returned as defective have been tampered with or repaired in any way.
      TopView Ltd. assumes no responsibility for damages resulting from accidental events of any nature occurring during the use of the products.<\/p>\n

      5 Intellectual Property<\/strong>
      The Intellectual Property and the related copyrights of the project and anything else that represents the subject matter of this contract are reserved to the Seller, notwithstanding the payment of the relevant fee by the Buyer, in accordance with articles. of the Civil Code, the Law for the Protection of Copyright and Other Rights Related to its Exercise\" as amended and supplemented.
      The Buyer acquires ownership of the Goods upon payment of the full purchase price of the goods.<\/p>\n

      6 Data Protection<\/strong>
      Seller fulfills its obligation to inform Buyer in accordance with Article 13 of Regulation 2016\/679 (hereinafter \"GDPR\") of the European Parliament.<\/p>\n

      7 Validity of the General Terms and Conditions of Sale - Amendments<\/strong>
      TopView Srl reserves the right to make amendments or additions to these General Terms and Conditions of Sale; such amendments and additions will not affect contracts already concluded and being executed.
      Any amendments and\/or additions will be effective from the date of their publication on the Site, which will be indicated at the top of the page https:\/\/shop.topview.it\/termini_condizioni_vendita<\/p>\n

      8 Applicable Law and Jurisdiction<\/strong>
      These Terms of Sale are governed by Italian law.
